Housyy AI TECH (ABN 27 862 510 788 (“Housyy”, “we”, “our”, or “us”) operates housyy.com.au and the Housyy mobile application (collectively, the “Platform”). This Privacy Policy explains how we collect, hold, use, disclose, and otherwise manage your personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (“APPs”).

By accessing or using the Platform, you acknowledge that you have read and understood this Privacy Policy. If you do not agree, please do not use the Platform.

This Policy applies to all users of the Platform, including sellers, buyers, renters, landlords, property developers, property marketers, and visitors.

2. Information We Collect

2.1 Information You Provide Directly

  • Account Information: name, email address, phone number, residential address, date of birth, and account credentials.
  • Property Information: property address, property descriptions, photographs, floor plans, valuation data, title information, and associated documentation.
  • Identity Verification: government-issued identification documents where required for verification or legal compliance.
  • Financial Information: payment card details, billing address, and transaction history (processed through our third-party payment provider).
  • Communications: messages, enquiries, feedback, and correspondence you send to us or through the Platform.
  • Professional Information: business name, ABN/ACN, developer licence details, real estate licence numbers (where applicable).

2.2 Information We Collect Automatically

  • Device and Usage Data: IP address, browser type, operating system, device identifiers, referring URLs, pages viewed, time spent, and clickstream data.
  • Location Data: approximate geographic location derived from IP address or, with your consent, precise location from your mobile device.
  • Cookies and Tracking Technologies: cookies, web beacons, pixels, and similar technologies. See Section 8 (Cookies) for details.
  • AI-Generated Data: data generated through your interaction with our AI tools, including valuation estimates, staging recommendations, photography guidance data, and property match scores.

2.3 Information from Third Parties

  • Public Records and Data Sources: property data from government registries, council records, Australian Bureau of Statistics, and licensed data providers.
  • Analytics Providers: aggregated analytics data from services such as Google Analytics.
  • Payment Processors: confirmation of payment status and fraud prevention data from our payment partners.

3. How We Use Your Information

We collect and use your personal information for the following purposes:

3.1 Platform Operations

  • Providing, maintaining, and improving the Platform and its features.
  • Processing property listings, valuations, and transactions.
  • Operating the Sell Hub, Buy Hub, and Developer Hub functionalities.
  • Facilitating communication between buyers, sellers, renters, landlords, and developers.
  • Processing payments and managing subscriptions.

3.2 AI and Data Processing

  • Generating AI-driven property valuations and market insights.
  • Providing AI staging, smart photography guidance, and listing optimisation.
  • Powering the Data Bridge to match supply with demand across all Hubs.
  • Calculating AI match scores for buyer-property compatibility.
  • Improving our AI models and algorithms (using de-identified and aggregated data where practicable).

3.3 Legal and Compliance

  • Complying with applicable Australian laws, regulations, and legal processes.
  • Preventing fraud, enforcing our Terms of Service, and protecting our rights and the safety of users.
  • Responding to lawful requests from government authorities and regulators.

3.4 Communications and Marketing

  • Sending service-related notices, updates, and alerts.
  • Sending marketing communications with your consent (you may opt out at any time).
  • Conducting research and analysis to improve our services.

4. Disclosure of Your Information

We may disclose your personal information to:

  • Other Platform Users: property information and relevant contact details shared between parties in a transaction (e.g., buyer enquiries to sellers, landlord details to prospective tenants).
  • Service Providers: third-party providers who assist with hosting, analytics, payment processing, customer support, AI model infrastructure, email delivery, and marketing. These providers are contractually obligated to protect your information.
  • Professional Advisers: lawyers, accountants, auditors, and insurers where necessary.
  • Government and Regulatory Bodies: where required by law or to respond to legal process, including the Australian Taxation Office, ASIC, ACCC, and state/territory fair trading bodies.
  • Business Transfers: in connection with a merger, acquisition, restructure, or sale of assets, where your information may be transferred as a business asset.

We do not sell your personal information to third parties for their independent marketing purposes.

5. Overseas Disclosure

Some of our service providers (including cloud hosting, AI model providers, and analytics services) may store or process data outside Australia, including in the United States, European Union, and Asia-Pacific regions. Before disclosing personal information overseas, we take reasonable steps to ensure recipients comply with the APPs or are subject to a substantially similar privacy regime (APP 8).

By using the Platform, you acknowledge and consent to this overseas disclosure. We will update this section with specific countries as our infrastructure evolves.

6. Data Security

We take reasonable steps to protect your personal information from misuse, interference, loss, and unauthorised access, modification, or disclosure (APP 11). Our security measures include:

  • Encryption of data in transit (TLS/SSL) and at rest.
  • Access controls and authentication mechanisms for internal systems.
  • Regular security assessments and vulnerability testing.
  • Staff training on data protection and privacy obligations.
  • Incident response procedures aligned with the Notifiable Data Breaches (NDB) scheme.

No system is completely secure. We cannot guarantee the absolute security of your information. You are responsible for maintaining the confidentiality of your account credentials.

7. Data Retention

We retain your personal information only for as long as necessary to fulfil the purposes outlined in this Policy, or as required by law. Specific retention periods include:

  • Account Data: retained for the duration of your account plus 7 years after account closure (to comply with Australian taxation and corporate record-keeping obligations).
  • Property Listing Data: retained for 7 years after listing completion or removal (for legal and regulatory compliance).
  • Transaction Records: retained for 7 years (as required under the Corporations Act 2001 and taxation law).
  • AI Training Data: de-identified and aggregated data may be retained indefinitely for model improvement.
  • Marketing Preferences: retained until you withdraw consent.

When personal information is no longer needed, we will take reasonable steps to destroy or de-identify it.

8. Cookies and Tracking Technologies

We use cookies and similar technologies to:

  • Maintain your session and remember your preferences.
  • Analyse usage patterns and improve the Platform.
  • Deliver targeted advertising (with your consent where required).
  • Prevent fraud and enhance security.

You can manage cookie preferences through your browser settings. Disabling certain cookies may affect Platform functionality.

We use Google Analytics and may use similar tools. You can opt out of Google Analytics by installing the Google Analytics Opt-out Browser Add-on.

9. Your Rights Under Australian Privacy Law

Under the APPs, you have the right to:

9.1 Access

Request access to the personal information we hold about you (APP 12). We will respond within 30 days. We may charge a reasonable fee for providing access.

9.2 Correction

Request correction of inaccurate, out-of-date, incomplete, irrelevant, or misleading personal information (APP 13).

9.3 Complaints

Lodge a complaint about our handling of your personal information. We will investigate and respond within 30 days. If you are not satisfied with our response, you may lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au.

9.4 Opting Out of Marketing

You may opt out of receiving marketing communications at any time by clicking the “unsubscribe” link in our emails, updating your account preferences, or contacting us directly. We will process your request within 5 business days.

9.5 Anonymity and Pseudonymity

Where practicable, you have the option to interact with us without identifying yourself (APP 2). However, certain Platform features (such as listing a property or making an offer) require identity verification and cannot be used anonymously.

10. Children’s Privacy

The Platform is not intended for individuals under 18 years of age. We do not knowingly collect personal information from children. If you believe we have inadvertently collected information from a child, please contact us immediately and we will take steps to delete such information.

11. Additional Rights for Users in the European Economic Area (EEA)

If you are located in the EEA or the United Kingdom, you may also have rights under the General Data Protection Regulation (GDPR), including the right to data portability, the right to erasure (“right to be forgotten”), the right to restrict processing, and the right to object to processing. Please contact us to exercise these rights.

Our lawful bases for processing under the GDPR include: performance of a contract, legitimate interests, consent, and compliance with legal obligations.

12. Notifiable Data Breaches

In the event of an eligible data breach (as defined under Part IIIC of the Privacy Act 1988), we will:

  • Conduct an assessment within 30 days of becoming aware of the breach.
  • Notify the OAIC and affected individuals as required under the Notifiable Data Breaches scheme.
  • Take reasonable steps to contain the breach and mitigate harm.

13. AI-Specific Disclosures

Housyy uses artificial intelligence and machine learning technologies across the Platform. You should be aware that:

  • AI valuations are estimates generated from publicly available data and proprietary algorithms. They are not formal property appraisals and should not be relied upon as such.
  • AI staging and photography tools process images you upload. These images may be temporarily stored for processing and then deleted, or retained in de-identified form for model training.
  • The Data Bridge uses aggregated and de-identified user preference data to match properties with potential buyers/renters. Individual identities are not disclosed in this matching process without your consent.
  • You may request human review of any significant AI-driven decision that affects you.
  • We regularly review our AI systems for bias, accuracy, and fairness.

14. Third-Party Links and Services

The Platform may contain links to third-party websites, applications, or services. We are not responsible for the privacy practices of these third parties. We encourage you to read their privacy policies before providing any personal information.

15. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will notify you of material changes by posting the updated Policy on the Platform with a revised “Last Updated” date, and where appropriate, by email notification. Your continued use of the Platform after changes are posted constitutes acceptance of the updated Policy.
